This Refund, Return & Cancellation Policy ("Policy") governs all purchases made through our website, by telephone, WhatsApp, email, social media, or any other sales channel operated by the Company. By placing an order, the customer ("Customer", "Buyer", or "you") acknowledges that they have read, understood, and agreed to be legally bound by this Policy.
This Policy forms an integral part of every quotation, proforma invoice, tax invoice, purchase order, order confirmation, and sales transaction conducted by the Company.
Jay Shree Mahakal Fabrics is a manufacturer, processor, and wholesale supplier of textile fabrics.
Our products are manufactured, dyed, printed, processed, finished, inspected, packed, and dispatched specifically against customer requirements. Due to the customized and production-based nature of our business, orders cannot be treated in the same manner as standard retail purchases.
An order shall be deemed confirmed immediately upon the occurrence of any one of the following:
Receipt of full or partial payment.
Customer approval through WhatsApp, telephone, or any written communication.
Acceptance of a quotation or Proforma Invoice.
Issuance of an Order Confirmation or Tax Invoice by the Company.
Commencement of manufacturing, processing, procurement, or production activities.
Once confirmed, the Company reserves production capacity, allocates raw materials, schedules manufacturing, and incurs operational costs on behalf of the Customer.
Cancellation requests may only be considered before any production or order-processing activities have commenced.
Once any of the following activities begin, the order becomes final, irrevocable, and non-cancellable:
Manufacturing
Dyeing
Printing
Processing
Fabric cutting
Packing
Dispatch preparation
Procurement of raw materials
Special production scheduling
Cancellation of custom-developed, made-to-order, exclusive, or specially manufactured products shall not be accepted under any circumstances.
The Company reserves the sole and absolute discretion to approve or reject any cancellation request.
Except where expressly stated in this Policy, all payments made to Jay Shree Mahakal Fabrics are final and non-refundable.
Refunds shall not be granted for, including but not limited to:
Change of mind.
Incorrect product selection by the Customer.
Incorrect colour selection.
Incorrect design selection.
Incorrect quantity ordered.
Delay caused by courier, transporter, logistics provider, or any third party.
Customer's business losses.
Market demand fluctuations.
Resale difficulties.
Customer's production planning changes.
Customer's inability to use the goods.
Delay caused by circumstances beyond the Company's reasonable control.
Minor textile variations within accepted industry tolerances.
A refund may only be considered if the Company determines, after inspection and verification, that:
An incorrect product was supplied by the Company.
The goods contain a material manufacturing defect.
The Company is unable to fulfil a confirmed order for reasons solely attributable to the Company.
Refund approval shall remain entirely at the Company's sole discretion.
If approved, refunds shall be processed within 7 to 15 business days through the original payment method or any other lawful payment method determined by the Company.
No refund shall exceed the original invoice value of the affected goods.
Returns are accepted only with prior written authorization from the Company.
Returned goods must satisfy all of the following conditions:
Reported within 48 hours of delivery.
Unused.
Unwashed.
Uncut.
Free from stains, marks, damage, or alteration.
In original packaging.
Accompanied by the original invoice and supporting documentation.
The Company reserves the right to reject any returned goods that fail to comply with these requirements.
Unauthorized returns shall not be accepted.
The Customer shall inspect all goods immediately upon delivery.
Any claim relating to:
Manufacturing defects
Wrong product supplied
Quantity shortage
Visible transport damage
must be submitted in writing within 48 hours of delivery together with:
Clear photographs
Videos (where applicable)
Invoice copy
Batch number or roll identification
Failure to notify the Company within the prescribed period shall constitute unconditional acceptance of the goods.
The Customer acknowledges and accepts that textile products are subject to commercially acceptable manufacturing variations.
Such variations may include, without limitation:
Colour shade
Dye lot variation
Print placement
Fabric width
GSM variation
Texture
Hand feel
Finish
Shrinkage
Printing alignment
Batch-to-batch variation
Furthermore, colours displayed on electronic devices may vary depending upon monitor calibration, mobile screens, photography, lighting conditions, and browser settings.
These variations are normal within the textile industry and shall not constitute defects, non-conformity, or grounds for cancellation, replacement, return, compensation, or refund.
The following products are manufactured specifically for individual Customers:
Custom printing
Custom dyeing
Exclusive developments
Customer-supplied designs
Sampling
Made-to-order production
Special colour developments
Bulk production against customer specifications
Such orders are strictly non-cancellable, non-returnable, non-exchangeable, and non-refundable, except where a material manufacturing defect is confirmed by the Company.
The Company shall not be liable for any delay, interruption, or failure to perform its obligations resulting from circumstances beyond its reasonable control, including but not limited to:
Natural disasters
Floods
Fire
Earthquakes
Pandemics
Government restrictions
Labour disputes
Transportation disruptions
Power failures
Shortage of raw materials
War
Civil unrest
Acts of God
Such events shall not constitute grounds for cancellation, compensation, damages, or refund.
To the maximum extent permitted by applicable law, the total liability of JK Textiles and its brand Jay Shree Mahakal Fabrics shall be strictly limited to the invoice value of the specific goods giving rise to the claim.
Under no circumstances shall the Company be liable for any indirect, incidental, consequential, exemplary, punitive, or special damages, including but not limited to:
Loss of profits
Loss of business
Loss of production
Manufacturing downtime
Loss of contracts
Loss of customers
Loss of goodwill
Commercial losses
Third-party claims
Delay damages
Any consequential financial loss
This Policy shall be governed by and construed in accordance with the laws of the Republic of India.
Any dispute arising out of or relating to this Policy, any purchase, or any commercial transaction with the Company shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.
The Company reserves the right to amend, revise, modify, or replace this Policy at any time without prior notice.
The version published on this website shall constitute the current and legally binding version.
Continued use of our website or continued business with the Company after any modification constitutes acceptance of the revised Policy.
